Adoption is an important option for both the child and people who wish to become parents. There are many requirements that adoptive parents must meet, including age, income and their ability to provide a safe and supportive environment for the child they want to care for as their own.
Texas adoption cases are the type of case that asks the court to make legal parents out of people who are not already biological parents. Which means this is not common for step parents of a child.
For adoption to occur, the parental rights of the child’s mother or father must first be terminated by the court. Later a petition for adoption would be filed in the court with jurisdiction over the child. The petition would be filed by the adoptive parent. If the adoptive parent is married then both spouses will be parties to the adoption suit.
The adoptive child must have resided with the adoptive parent for at least six months before the suit is filed.
Shortly after the adoption petition is filed, the court will appoint a Guardian Ad Litem (GAL) to represent the child in the adoption case. The GAL’s role is to interview the child and adoptive parent(s) and report back to the court whether or not the adoption is in the best interest of the child. The GAL will also look into the circumstances of the adoption, the child’s welfare, and the backgrounds of the adoptive parent(s).
